Standard Terms and Conditions

In this agreement:
“Creative Video” means Creative Video Limited
“The Client” means any business or person who uses our products or services

1.  The Agreement
All video services are performed strictly on the basis of the terms and conditions listed in this agreement.

2.  Booking & Payment
To confirm your booking with Creative Video, deposit of $500 is required.  Until payment has been received and cleared, your booking date will not be considered secured and your selected date will remain available to other parties.  If a date is no longer available, any subsequent deposit received will be returned to the sender with no further liability on either party.
The full balance is payable upon completion of your wedding videos.  In most cases, your finished product will be completed and available approximately six to ten weeks after your wedding date.  Should you require your video earlier, please discuss your requirements with us. 
Payment may be made by cheque or bank transfer.  Your wedding videos will be dispatched once payment has been received and cleared.  You are welcome to collect your wedding videos from our studio, or a courier can be arranged for delivery at the Client’s cost.  
Full payment and collection must be made within 3 months of the completion of your wedding videos. 

3.  Cancellations
A cancellation fee equal to the deposit amount paid will be charged for any cancellation notified within 6 months of the booking date. 
No cancellation fee will be charged for cancelled or postponed dates where Creative Video is offered an alternative confirmed booking to replace the cancelled or postponed date(s).
Should a cancellation occur due to force majeure / acts of god, then the parties shall negotiate in good faith regarding cancellation fees.

4.  Travel and Additional Costs
All prices quoted include travel within a 20 km radius from our studio in Avondale, Auckland.  Any additional mileage will be charged at a rate of $1.20 per km.
Additional travel costs which may be incurred on the day will be at the Client’s expense – this includes ferry transport to Waiheke Island, parking at predetermined venues and access to photo shoot locations.
Where a videographer is required to stay overnight to meet the Client’s booking requirements, suitable “bed and breakfast” accommodation must be provided at the Client’s expense. 
All flight expenses for bookings out of Auckland will be charged at the Client’s expense.  All booking arrangements are to be discussed and agreed with the Client.
Depending on the circumstances, there may be additional charges and the Client(s) will be advised before any variation to the contract is agreed or accepted.

5.  Additional Hours and Meal Provisions
Should you require your videographer to stay past the maximum specified hours as outlined in your selected package, an additional hourly rate of $200.00 (including GST) will be charged per hour.
If your selected wedding package involves over 8 hours of continuous work, the provision of a meal/refreshments for your videographer would be appreciated.  Most venues are happy to provide a meal to suppliers when requested. 

6.  Substitution
In the unlikely event of serious personal injury or emergency circumstances beyond the control of Creative Video, a substitute videographer, subject to the acceptance by the Client, may be dispatched to fulfil the obligations of videography herein contracted.  If securing a videographer is not possible, or if the Client declines such substitution, the Client will receive a full refund of the deposit paid.  Total liability of Creative Video is limited to the refund of the deposit and any monies paid toward the final cost of the video.

7.  Filming the Day
Any variations in the times, dates, or to the planned event that may impact on the contract should be communicated to Creative Video as soon as possible.
Creative Video will abide by all rules of the facility and/or directions of staff (if applicable) and/or facility coordinator(s) in regard to camera set-up and will not be held responsible for absence of certain shots due to such rules and/or directions, or due to interference by wedding guests or vendors, including the photographer.  
The Client acknowledges that videography requires reasonable lighting and that production may be compromised due to low or poor light levels.   While we aim to be discreet, in certain low light situations, Creative Video may suggest use of a professional camera-mounted light as approved by the Client.
Creative Video will endeavour to protect the safety of their staff and interested parties.  Any shot, location or action on set that is not deemed as safe, may be terminated at the Creative Video’s discretion.  Creative Video reserves the right to remove any individual or group from a set/location that is causing distraction and/or deemed dangerous to the crew.
While we appreciate that family members may also wish to capture your day, should we feel that they are impeding our job on the day, we will politely ask them to step aside so that we may fulfil our duties to the Client.
We use broadcast quality well maintained equipment, however we will not be liable for any radio signal losses, battery failures, equipment failure and or material defects, which are beyond our control.  In the unlikely event of a total video failure our liabilities are limited to a refund of all monies paid by the Client(s).
Every effort is made to ensure perfect colour and lighting reproduction, but certain conditions may not be accurate such as mixed indoor and external lighting, hard shadows and low lighting conditions.
With these factors beyond our control, we will endeavour to produce the best pictures possible.
The handling of all production equipment is to be carried out by the selected crew of Creative Video unless prior arrangement has been made.  Creative Video shall be entitled to recover any losses for damage incurred by the Client.  The Client will not do any act or thing whereby any insurance in respect of the equipment may be prejudiced in any way.

8.  The Edit
Creative Video videographers will always consider the requirements and desires of the Client in terms of video capture, editing and style, but reserve the right to use their professional opinion in any circumstance.  Artistic interpretation cannot be guaranteed but every attempt will be made to comply with the Client(s) wishes.
The Client has had the opportunity to view samples of Creative Video’s work and is completely satisfied with its quality and with Creative Video’s video production capabilities and artistic style.  In the unlikely event that you are not totally satisfied with your wedding video, Creative Video will be happy to address any minor amendments at no additional cost within 14 days of the Client receiving the videos.  Changes to the finished product to accommodate aesthetic or personal tastes will result in additional fees and will be addressed with the Client on a case by case basis. 
As each video project is different in nature, Creative Video cannot guarantee the specific length of each video.

9.  Acceptance of Goods.
The Client(s) shall within fourteen days from the delivery of goods give written notice to Creative Video of any respect in which it is alleged that the Goods do not comply with the Contract.  Subject to any such notice, the goods will be deemed to comply with the Contract in all respects.

10.  Outstanding Payment
Should the Client not be able to meet the payment terms, Creative Video would in the first instance, appreciate the Client making arrangements to enter into a mutually agreeable payment plan.  Interest will be charged on all outstanding amounts. 
Creative Video reserves the right in the event of the Client failing to pay for the production and/or services, to provide relevant details to a debt collector or agency for the costs incurred.  Interest may be charged on any amount owing after the due date at the rate of 2.5% per month or part month.  Any expenses, disbursements and legal costs incurred by Creative Video in the enforcement of any rights contained in this contract shall be paid by the Client, including any reasonable solicitor’s fees or debt collection agency fees.

11. Copyright
The Client gives permission and Creative Video reserves the right, to use any or all video and digital photographs for Creative Video promotional, marketing and/or advertising purposes unless otherwise advised to us in writing by the Client.
The Client Agrees that all participants give their consent to being recorded (videotaped) and consent to the same usages of their likeness images and/or voices previously described above.  The Client assumes responsibility for such release and authorisation and for notification to all participants.

12. Confidentiality
To protect the interest of both parties, any information relating to any production and video concepts remain confidential and should only be discussed with Creative Video’s crew, promoter and artist/s.

13. Additional Terms and Conditions
Creative Video will retain a master copy of your film in our archives.   
The prices within this contract are current at the time of viewing and are inclusive of GST.  Creative Video reserves the right to change and amend this contract without notice at which point prices may change.
